- Reproduce the image as is, for commercial purposes.
The user is hereby informed that unauthorized commercial use will result in the user being civilly and/or criminally liable for copyright infringement.
- Reproduce or provide the image to more than 20 (twenty) people, particularly through the duplication of the file or by making it available via Internet, intranet, or extranet networks or through file sharing.
- Create a scandalous, obscene or immoral work using the photographic image.
- Distribute or sell the image by associating it with another product in competition with the image.
- Use the photographic image relating to any identifiable persons, goods or entities in any way likely to bring the image of such persons, goods or entities into disrepute, in particular by conferring upon it anything of a scandalous, obscene, immoral or similarly degrading nature, or which might suggest any link or association with any product, service or concept, by giving it a controversial, unfair, parasitical or defamatory nature.
- Crop individual people from groups larger than 4 persons and use them as individuals in your design.
- Rent, sell, lend or otherwise grant rights to the image outside of the cases referred to above.
This license entitles the user to the copyright of the photographs and the image rights of the models photographed. The user may not, however, use or reprocess the image in such a way that they might infringe upon tangible or intangible property rights (e.g. reframing a monument in close-up).
In consequence thereof, the user is fully liable for any use he may make of the photographic image which may require specific permission from third parties in respect to any tangible or intangible property rights which may be claimed and which are expressly excluded from the terms of this license.
PhotoAlto disclaims any responsibility relative to the use of these photographs which could constitute an infringement on the rights of third parties.
In case of any doubt, the user may contact PhotoAlto at the above address (art.1). 4 - Photographer :
Pursuant to the provisions of Articles L 121-1 et seq. of the French Intellectual Property Code, all use of the photographic images is subject to the citation of the photographer and PhotoAlto. 5 - Duration :
This User's License shall remain in full force and effect throughout the entire duration of use of the image. It shall be terminated in the event that the user does not comply with the terms and conditions herein.
Upon expiration of this License Agreement, the user hereby agrees to destroy all copies made of the image. 6 - Warranty :
PhotoAlto hereby guarantees the workmanship of this image for three days starting from and including the date of purchase.
In the event of a defect due to downloading appearing during the three day period, PhotoAlto's distributor will replace the defective image. 7 - Disclaimer of warranty and liability :
The image is provided as is, under the guarantees provided above. All risks related to the results or performance of the image are assumed by the user. 8 - This English-language contract is a translation; in the event of a dispute, the contract having precedence is the original contract written in French. Tous les copyright et les autres droits attachés appartiennent à la société PhotoAlto ou à ses fournisseurs.
L'utilisation emporte présomption irréfragable pour l'utilisateur d'avoir pris connaissance des présentes, et d'y avoir adhéré sans réserve.
2 - L'utilisateur est en droit de :
- Reproduire, représenter, imprimer, adapter, publier l'image photographique par l'intermédiaire de n'importe quel support sous réserve des conditions décrites ci-dessous.
- Faire une copie supplémentaire de l'image dans un but d'archivage ou de mémorisation.
- Exploiter une ou plusieurs images photographiques pour le compte d'un tiers, non titulaire de la présente licence, à condition que cette exploitation ne permette pas au tiers un accès libre de l'ensemble des images photographiques, qui en ferait un utilisateur selon la définition donnée aux présentes.
L'utilisateur demeure responsable et garant du tiers vis-à-vis de PhotoAlto en ce qui concerne le respect des termes des présentes.
3 - L'utilisateur n'a aucun droit de :
- Recopier l'image ainsi que les notices explicatives ci-annexées sous réserve des cas autorisés par le présent contrat de licence.
- Reproduire telle quelle l'image en vue de sa commercialisation.
L'utilisateur est informé que cette commercialisation prohibée entraînerait la mise en œuvre de sa responsabilité civile et/ou pénale, sur le terrain de la contrefaçon.
- Reproduire ou mettre à disposition de plus de 20 (vingt) personnes l'image, notamment par la duplication, la mise en réseau internet, intranet, extranet ou le partage de fichiers.
- Créer une œuvre scandaleuse, obscène ou immorale grâce à l'utilisation des images photographiques.
- Distribuer ou vendre l'image en association avec un autre produit qui lui serait concurrent.
- Utiliser l'image photographique concernant des personnes, des biens ou des entités identifiables d'une manière qui pourrait porter atteinte à l'image de ces personnes, de ces biens ou de ces entités, notamment en lui conférant un caractère scandaleux, obscène, immoral, etc., ou qui pourrait suggérer un quelconque lien ou une quelconque association avec tout produit, service ou concept en lui conférant un caractère polémique, déloyal, parasitaire, diffamant.
- Recadrer ou faire recadrer l'image d'une personne contenue dans une photographie originale représentant plus de quatre personnes et de l'utiliser de façon individuelle.
- Louer, céder, prêter ou accorder des droits sur l'image en dehors des cas cités ci-dessus.
- La présente licence assure à l'utilisateur les droits d'auteur des photographes et les droits à l'image des modèles photographiés.
Cependant, l'utilisateur ne pourra pas utiliser ou retraiter l'image de telle sorte qu'elle pourrait violer des droits de propriété corporels ou incorporels (ex.: recadrage en gros plan d'un monument).
Par conséquent, l'utilisateur prend l'entière responsabilité des utilisations qu'il ferait de l'image photographique et qui nécessiterait des autorisations particulières de tiers, en raison de droits de propriété corporels ou incorporels qui pourraient être revendiqués et qui sont expressément exclus de la présente licence.
La société PhotoAlto décline toute responsabilité relative à l'utilisation des photographies qui constituerait une atteinte quelconque aux droits de la personnalité de tiers.
En cas de doute, l'utilisateur peut contacter la société PhotoAlto dont les coordonnées figurent ci-dessus (art.1).
4 - Auteur :
Par application des dispositions des articles L 121-1 et suivants du code de la propriété intellectuelle, toute utilisation de l'image est subordonnée à la précision de la mention du nom du photographe et PhotoAlto.
5 - Durée :
Cette licence d'utilisation portera ses effets pendant toute la période d'utilisation de l'image. Elle prendra fin dans l'hypothèse ou l'utilisateur n'en respecterait pas les termes et conditions.
L'utilisateur s'engage à l'expiration du présent contrat de licence à détruire toutes les copies de l'image qu'il aurait faites.
6 - Garantie :
La société PhotoAlto garantit la bonne qualité de l'image pendant une durée de trois jours à compter de la date d'acquisition.
En cas de découverte d'un défaut lié au téléchargement lors de cette période de trois jours, le distributeur de la société PhotoAlto s'engage à remplacer l'image défectueuse.
7 - Limitation de la garantie et responsabilité :
Sous réserve des garanties prévues à l'article précédent, l'image est fournie telle quelle. Tous les risques liés aux résultats et performances de l'image doivent être assumés par l'utilisateur.
8 - Loi applicable :
Le présent contrat est gouverné par le droit français.

- Recadrer ou faire recadrer l'image d'une personne contenue dans une photographie originale représentant plus de quatre personnes et de l'utiliser de façon individuelle.
